INTRODUCTION

Lanakila Pacific is a 501(c)(3) nonprofit organization in Hawaii that provides services and social enterprise programs that build independence and improve the quality of life for individuals with cognitive, physical, social, or age-related challenges.  Founded in 1939 as a rehabilitation program for people recovering from tuberculosis, Lanakila Pacific has evolved to achieve its mission through uniquely integrating programs, social enterprises, and employment opportunities.  

Our vision is “to embody self-sufficiency and inspire inclusive communities where people of all ages and abilities are empowered to find meaningful employment, live independently and thrive in spirit.” 

Lanakila Pacific has a duty to protect the confidentiality of private, non-public donor information. Respect for a donor’s right to privacy is a basic standard of integrity for all activities.

This Web Use Terms and Conditions Agreement (the “Agreement”) is between you (“you” or “user”) and the Lanakila Pacific (the “Organization”, “we” or “us”) regarding your use of the Lanakila Pacific’s website (“site”). By using this website, you agree to abide by the terms and conditions of use set forth herein. You acknowledge that you have read this Agreement and that you accept the terms thereof. GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of the State of Hawaii, without giving effect to any principles of conflicts of law.  In the event that any legal proceedings are commenced in any court with respect to any matter arising under this Agreement, the parties hereto specifically consent and agree that the courts of the State of Hawaii and/or the United States District Court for the District of Hawaii shall have exclusive jurisdiction over each of the parties hereto and over the subject matter of any such proceedings; and the venue of any such action shall be in Honolulu, Hawaii; provided, however, that the Organization may bring an action to enforce this Agreement in any other jurisdiction.

MISCELLANEOUS

If any provision of this agreement is found to be invalid and unenforceable by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this agreement, which shall remain in full force and effect.

No waiver of any term of this agreement shall be deemed a further or continuing waiver of such term or any other term.

This agreement constitutes the entire agreement between you and us with respect to the use of our website.
